Trước khi bỏ phiếu, Chủ nhiệm Ủy ban Kinh tế Vũ Hồng Thanh thay mặt Ủy ban Thường vụ Quốc hội trình bày báo cáo giải trình, tiếp thu, chỉnh lý dự thảo Luật Kinh doanh bất động sản sửa đổi.
Nhiều ý kiến đại biểu đề nghị quy định bắt buộc thực hiện thanh toán không dùng tiền mặt trong các giao dịch bất động sản để bảo đảm thực hiện mục tiêu phòng, chống tham nhũng.
Nội dung này đã được tiếp thu, luật đã quy định “chủ đầu tư dự án, doanh nghiệp kinh doanh bất động sản nhận tiền thanh toán theo hợp đồng kinh doanh bất động sản, hợp đồng kinh doanh dịch vụ bất động sản từ khách hàng thông qua tài khoản ngân hàng. Bảo đảm kiểm soát dòng tiền giao dịch bất động sản của chủ đầu tư dự án, doanh nghiệp kinh doanh bất động sản”.
Đối với trường hợp cá nhân kinh doanh bất động sản quy mô nhỏ, tổ chức, cá nhân bán nhà ở, công trình xây dựng, phần diện tích sàn xây dựng trong công trình xây dựng không nhằm mục đích kinh doanh… thì không cần thiết bắt buộc thanh toán qua ngân hàng, tránh can thiệp sâu vào các giao dịch dân sự.
Về đặt cọc trong kinh doanh bất động sản, luật quy định chủ đầu tư dự án chỉ được thu tiền đặt cọc không quá 5% giá bán, cho thuê mua nhà ở, công trình xây dựng, phần diện tích sàn xây dựng khi đã có đủ các điều kiện đưa vào kinh doanh theo quy định. Thỏa thuận đặt cọc phải ghi rõ giá bán, cho thuê mua…
